1. Acceptance of Terms

Welcome to Fantasy Book, operated by Liminal Data Systems, LLC ("Company," "we," "us," or "our"). By accessing or using the Fantasy Book website and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Fantasy Book is a fantasy sports platform that allows users to create and manage fantasy sports teams, participate in leagues, and track performance. The Service is provided for entertainment purposes only.

Fantasy Book is not affiliated with, endorsed by, or sponsored by any professional sports league, team, or player association, including but not limited to the NFL, NBA, MLB, or any other professional sports organization.

Fantasy Book is not a gambling or wagering site. The Service does not involve real-money betting, and no monetary prizes are currently offered for game participation. Any future prize or reward systems will be subject to additional terms and conditions.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration and Security

4.1 Account Creation

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate
  • Notify us immediately of any unauthorized use of your account
  • Maintain only one account per person; creating multiple accounts is prohibited and may result in suspension

4.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

5. Account Termination and Suspension

5.1 Our Right to Terminate or Suspend

We reserve the right, in our sole discretion, to:

  • Suspend or terminate your account at any time, for any reason or no reason
  • Refuse service to anyone for any reason
  • Remove or disable access to any content or user data

We may exercise these rights without prior notice and without liability to you.

6. User Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Harass, abuse, threaten, or intimidate other users
  • Upload or transmit viruses, malware, or other malicious code
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Use automated systems, bots, or scrapers to access the Service without our prior written consent
  • Use any data, statistics, or content from the Service to build, train, or operate any external product or service without our prior written consent
  • Engage in collusion, account sharing, or any coordinated effort to gain an unfair advantage over other users
  • Manipulate or exploit game mechanics in unintended ways
  • Engage in any activity that disrupts or interferes with the Service
  • Use the Service for any commercial purpose without our prior written consent

Violation of these rules may result in immediate account suspension or termination.

7. Game Rules and Scoring

7.1 League Participation

By participating in fantasy leagues, you agree to:

  • Follow the rules and scoring systems established for each league
  • Accept that league commissioners may modify league settings
  • Acknowledge that game outcomes are final once scoring periods conclude

7.2 No Guaranteed Prizes or Rewards

The Service does not currently offer prizes, monetary rewards, or other compensation for game participation. All play is for entertainment purposes only.

8. Intellectual Property

8.1 Our Property

The Service, including all content, features, functionality, software, logos, text, graphics, and trademarks, is owned by Liminal Data Systems, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. The Fantasy Book name, logo, and related marks are trademarks of Liminal Data Systems, LLC and may not be used without our prior written consent.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms. This license does not include the right to reproduce, distribute, or create derivative works from any content on the Service.

8.3 Data Use Restrictions

You may not use any data, player statistics, scoring information, or other content obtained from the Service to power, train, or otherwise support any external application, product, or service without our prior written consent.

9. Third-Party Content and Data

Player statistics and game data are obtained from third-party sources and are provided for entertainment purposes only. We do not guarantee the accuracy, completeness, or timeliness of such data and are not responsible for errors or omissions in third-party information.

The Service may contain links to or integrate third-party services. We are not responsible for the content, accuracy, or practices of those third parties. Your interactions with third parties are solely between you and the third party.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LIMINAL DATA SYSTEMS, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

12. Indemnification

You agree to indemnify, defend, and hold harmless Liminal Data Systems, LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of any rights of another party, or any content you submit to the Service.

13. Privacy

Your privacy is important to us. By using the Service, you consent to our collection and use of information as described in our Privacy Policy.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service and updating the "Last Updated" date above. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

15. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, introduce premium features or paid services, or change game rules, scoring systems, or league formats. We will provide reasonable notice of material changes when practical but are not obligated to do so.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions. Any legal action or proceeding arising from these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in New Mexico, and you consent to the personal jurisdiction of such courts.

Before filing any legal action, you agree to attempt to resolve disputes informally by contacting us. We will attempt to resolve disputes in good faith.

17. General Provisions

These Terms constitute the entire agreement between you and Liminal Data Systems, LLC regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right shall not constitute a waiver. You may not assign these Terms or your account without our prior written consent. We shall not be liable for failures or delays caused by circumstances beyond our reasonable control.
